Introduction

Paatly respects the intellectual property rights of copyright owners, their agents, and other rights holders. This policy explains how copyright owners may report material available on Paatly that they believe infringes their rights.

Copyright Infringement Notice

If you are a copyright owner, or are authorized to act on behalf of one, and believe that material available on Paatly infringes an exclusive right, please send a written notice containing the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner’s behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If the notice concerns multiple copyrighted works available on Paatly, you may provide a representative list of those works.
  3. Identification of the material claimed to be infringing, or to be the subject of infringing activity, together with information reasonably sufficient to help Paatly locate it. Please include the exact URL of each relevant Paatly page whenever possible.
  4. Information reasonably sufficient to allow Paatly to contact you, such as your full name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please ensure that your notice contains all the information listed above. Missing or inaccurate information may prevent Paatly from locating the material or may delay the review of your notice.

Notice-and-Takedown Procedure

When Paatly receives a sufficiently complete copyright infringement notice, we may review the notice, contact the sender for additional information, and remove or disable access to the identified material where appropriate.

Where material was submitted by an identifiable user or contributor, Paatly may provide that person with information about the removal and the copyright notice, where required or appropriate.

Paatly may also forward relevant portions of a notice or counter-notification to the affected parties as necessary to process the claim. Personal information submitted in connection with a claim should therefore be limited to information required for the legal process.

Submitting a copyright notice does not guarantee that material will be removed. Paatly may decline to act on notices that are incomplete, concern material that cannot be located, do not establish the sender’s authority, or do not otherwise provide a sufficient legal basis for removal.

Counter-Notification

If material you submitted was removed or disabled because of a copyright infringement notice, and you believe that the removal resulted from a mistake or misidentification, you may send a written counter-notification to the copyright contact listed above.

A counter-notification should include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location at which it appeared before it was removed or disabled.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled because of a mistake or misidentification.
  4. Your name, mailing address, and telephone number.
  5. A statement that you consent to the jurisdiction of the appropriate United States Federal District Court as required by 17 U.S.C. Section 512(g)(3), and that you will accept service of process from the person who submitted the original infringement notice or that person’s agent.

If Paatly receives a valid counter-notification, we may provide a copy to the person who submitted the original copyright notice.

Where the DMCA applies, removed material may be restored no earlier than 10 and no later than 14 business days after receipt of the counter-notification unless the original complaining party informs us that it has filed a court action seeking to prevent restoration of the material.

Misrepresentation

Copyright notices and counter-notifications are legal communications. Knowingly misrepresenting that material is infringing, or that material was removed by mistake or misidentification, may result in liability under applicable law.

If you are uncertain whether material infringes your copyright, whether an exception or limitation applies, or whether you are authorized to submit a notice, you should consider obtaining independent legal advice before contacting Paatly.

Repeat Infringers

Where appropriate and within our reasonable control, Paatly may restrict or terminate the ability of users or contributors who repeatedly submit infringing material to use Paatly’s contribution services.

Paatly may consider the circumstances surrounding each matter when applying this policy.

Standard Technical Measures

Where applicable, Paatly seeks to accommodate and not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, provided those measures satisfy the requirements of applicable law and do not impose substantial costs or burdens on Paatly’s systems.

Changes to This Policy

Paatly may update this DMCA Policy to reflect changes to our services, procedures, or applicable legal requirements. Any updated version will be published on this page with a revised “Last updated” date.
